Recent Tribunal Case – Don’t get caught out…
After reading Personnel Today, Stephen Simpsons’ article Monday 10th October, we wanted to share why it’s important having an HR and Recruitment Partner assisting with the person specification. The Jones v Care UK Clinical Services Ltd case demonstrates how easily employers can get caught out.
Jones was rejected after his interview for being “over-qualified” but then took Care Uk Services Limited to court for “age discrimination”. Luckily, Care UK Services Ltd proved, with interview notes, Mr Jones’ skills in relation to engagement with stakeholders were beyond what was needed; and expectations of his development in the job could not be fulfilled because of the constraints of the role.
A successful placement should follow a solid person specification which can save time interviewing the wrong people with the wrong criteria which in turn eliminates tribunal claims.
